1. Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you") and PURR ENTERPRISES LIMITED ("Company," "we," "us") governing your use of the "PDF Doc Scanning App - NexScan" mobile application ("App").
By downloading, installing, accessing, or using the App, you confirm that you have read and understood these Terms, that you are at least 18 years old or have permission from a parent or guardian to use the App, and that you agree to comply with these Terms at all times.
If you do not agree to these Terms, immediately cease all use of the App.
2. App Functionality & Description of Services
The App offers a set of tools to help you capture, process, and organize your documents. Key features include:
- scanning documents using your device's camera;
- importing images or files from your gallery for conversion into PDF;
- converting captured or imported images into PDF format;
- adding signatures to documents within the App.
A few things to note:
- Accuracy not guaranteed: Image quality depends on camera performance, lighting, and the original file.
- Device differences: Processing speed and feature availability may vary depending on your iPhone model, iOS version, and settings.
3. Acceptable Use Policy
3.1. Permitted Use. You are welcome to use the App for your own personal, non-commercial purposes. Your use must comply with these Terms, Apple’s App Store policies, and all applicable local, national, and international laws.
3.2. Prohibited Conduct. You agree not to:
- use the App to delete or modify data without legal rights;
- reverse-engineer, decompile, or extract the App’s source code;
- bypass security features or exploit vulnerabilities;
- distribute malware, spam, or harmful content through the App.
4. Intellectual Property Rights
Everything in the App — its design, software, brand, and features — is owned by us. You do not obtain ownership merely by using it, and you may not reuse any part of it unless we provide written permission.
If the App allows uploading files, such as for cloud features, you retain ownership of your content. We only access or process it to provide the service.
5. Privacy & Data Handling
To perform key functions, the App may access your storage and camera. We explain exactly what data we use and why in our Privacy Policy.
6. Payments, Subscriptions & Refunds
Some advanced features require a subscription ("Premium"), which is handled through Apple’s in-app purchase system.
Refunds are managed solely by Apple. Please contact Apple directly regarding refund questions.
7. User Responsibilities
To keep things running smoothly, you agree to:
- back up your data and always store important documents in a secure location outside the App;
- secure your Apple ID, since you are responsible for any purchases made using your account;
- use the App lawfully and only scan, import, sign, or share documents that you have the legal right to handle.
8. Disclaimers & Limitation of Liability
8.1. No Warranty. The application is provided "as is" and "as available" without warranties of any kind. PURR ENTERPRISES LIMITED expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the application will meet your requirements, operate uninterrupted, be secure or error-free, or that its results will be accurate or reliable. Your use of the application is at your sole risk.
8.2. Limitation of Liability. To the maximum extent permitted by law, PURR ENTERPRISES LIMITED, its affiliates, employees, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, business interruption, or other intangible losses, arising from or related to your use of or inability to use the application, unauthorized access to or alteration of your content, conduct of any third party, or any other matter relating to the application.
This limitation applies regardless of the legal theory and even if advised of the possibility of such damages. Your only remedy for dissatisfaction with the application is to stop using it.
9. Termination
If you break these Terms or misuse the App, we may suspend or permanently disable your access.
Upon termination:
- all licenses granted herein cease immediately;
- paid subscriptions will not be prorated.
10. Laws
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Cyprus.
